Replika's new privacy policy and terms: what changed on October 28, 2026
Replika published a new privacy policy and new terms, both dated October 28, 2026. Text chat history is now kept for 24 months and photos, videos and voice messages for 12 months while an account is open. Free accounts unused for 12 months may be deleted, with an email at least 60 days ahead. Replika may ask for a selfie or ID age check through Incode, and existing users get 30 days to opt out of arbitration.

Replika, the AI companion app from Luka, Inc., has rewritten both its privacy policy and its terms of service. Both are dated October 28, and Replika flagged them in the app that evening. They replace a privacy policy dated May 27 and terms dated March 30, both from earlier this year. Most of the new text sets out in detail what the old documents left vague, but several rules are new: how long your chats are kept, when an unused account can be deleted, how Replika may check your age, and a way to opt out of arbitration. We compared both documents line by line with the copies the Internet Archive saved on October 21.
What changed in the privacy policy
| Policy of May 27 | Policy of October 28 | |
|---|---|---|
| Chat history while your account is open | No limit stated; messages kept until the account ends, then up to 60 days | Text kept for 24 months; photos, videos and voice messages for 12 months; media saved to memories, the diary or your profile kept for the life of the account |
| Unused accounts | Not mentioned | Free accounts unused for 12 months may be deleted, with an email at least 60 days ahead where possible |
| Age checks | Not mentioned | A selfie or ID check through Incode where the law requires it or the stated age is in doubt |
| Advertising partners | "Advertising companies" receive data about visits to the website | Named as Meta, Google and AppsFlyer; covers app installs, sign-ups, trials and purchases, a scrambled account ID and, outside the EU, UK, Brazil and Switzerland, a scrambled email address |
| Payment records | At least 10 years after the contract ends | 10 years from the end of the year of the purchase |
The new chat rule applies to every account, paid or free. Media you save to your Replika's memories, its diary or your profile is the exception and stays as long as the account does. The policy does not say whether older messages disappear from the app in one go or gradually, or whether users will be told before the first ones go.
The inactivity rule covers only accounts that have never bought anything. A subscription, a lifetime plan, an unspent purchased balance or purchased items all keep an account safe. Logging in before the deletion date also keeps it, and anything earned for free is lost if it goes.
The age check is new to the policy. Replika says a selfie is analysed on your phone where possible; otherwise Incode Technologies processes the selfie, or the ID document and its photo, and deletes the biometric data within 24 hours. Replika keeps only an age band, the method and a timestamp. If the check is required and you decline or cannot pass it, you lose access to Replika or to the features that need it. When we set up a new Android account on October 5, the only age question was a birthday.
The policy also says that people who start on Replika's website may be asked onboarding questions about their interests, goals, relationships and "what is on your mind lately" before creating an account, and that the answers are used to set up their Replika. On advertising, the policy repeats that conversations, photos and other content you share in the app are never passed to advertising partners or used for marketing.
What changed in the terms
The old terms listed four programmes by name: Free Use, which they described as aimed at users who cannot afford a paid plan, then Pro, Ultra and Platinum. The new terms name no plans. They say plan names, prices and allowances are whatever the subscription screen shows when you buy, and that they vary by version of the app, platform and country. When we read the paywall on September 30, it sold two yearly plans, Plus and Max.
Other changes:
- Two versions of Replika. The terms now describe "the classic Replika experience and Replika 2.0", with different features, avatars, memory systems and models. Moving to 2.0 does not change the plan you bought; if you buy a 2.0 plan, the checkout shows the price, any credit for your old plan and any period in which you can go back.
- Lifetime and older plans. You keep the plan you bought, with the features and allowances described when you bought it, for the version it was bought for. A lifetime plan is perpetual access to that plan, "not to all current or future Replika products, versions, or plans".
- Usage allowances. Paid plans may come with daily or weekly limits, such as chat replies per day, call minutes per day or images per week, which do not roll over. Replika promises not to cut a plan's allowances during a paid term and to give notice before a worse change applies at renewal.
- Suns, Zaps and Top-Ups. Replika's virtual currencies can buy extra images, call minutes or chat replies. Purchased Top-Ups never expire, but they can be used only while a subscription is active.
- Buying on the web. Replika now sells subscriptions on its website as well as through Apple and Google, and a web subscription can be cancelled online from the account settings.
- Arbitration opt-out. Disputes still go to binding arbitration, but users can now opt out by emailing my@replika.com within 30 days. For existing users the clock starts when the new terms were first posted; with the October 28 date, that runs to around November 27.
What to do if you use Replika
- Save any photos, videos or voice messages you want to keep to your Replika's memories or diary; media there is kept for the life of the account.
- If you use Replika for free and take long breaks, open the app at least once a year, or watch for Replika's 60-day warning email.
- If you would rather settle a dispute in court than in arbitration, send your opt-out before the 30 days run out.
- US users who do not want their activity shared with Meta and Google can opt out under Your Privacy Choices in the app's settings or the website footer.
Replika told users with a notice in the app, which users on r/ReplikaOfficial began posting about at 7:12 p.m. Eastern on October 28; tapping "Got it" closes it. By the evening of October 29 Replika had not explained the changes on its blog or in a post on its official subreddit. We will add any announcement here with its date.

Frequently asked questions
Does Replika delete old messages?
Its privacy policy of October 28, 2026 says that while your account is open it keeps conversation history for 24 months for text messages and 12 months for photos, videos and voice messages, the same for every account. Media you save to memories, the diary or your profile is kept for as long as the account exists. The previous policy, dated May 27, 2026, set no limit while the account was open. The policy does not say how older messages are removed.
Does Replika delete inactive accounts?
Only free ones. If you have never made a purchase and have not used Replika for 12 months, it may delete the account and its data. Replika says it will email you at least 60 days before where it can, that using the app before the date keeps the account, and that free-earned currency and items are lost. Accounts with any purchase, including a lifetime plan or an unspent purchased balance, are not deleted for inactivity.
Does Replika verify age with a selfie or ID?
It can. The new policy says that where the law requires it, or where Replika doubts the age you gave, it may ask for a selfie or an identity document, checked by Incode Technologies or on your own device. Replika says it receives only an age band and a timestamp and that the biometric data is deleted within 24 hours. Most users still just enter a birthday at sign-up.
What is Replika 2.0?
Replika's new terms describe two generations of the app, the classic Replika experience and Replika 2.0, with different features, avatars, memory systems and models. Moving an account to 2.0 does not change the plan you bought, and lifetime plans cover the plan purchased rather than every later version.
Can you opt out of Replika's arbitration clause?
Yes, under the new terms. Existing users can opt out within 30 days after the terms were first posted by emailing my@replika.com with their name, the account's email address and a clear statement that they opt out. The terms are dated October 28, 2026, which puts the end of that window around November 27. The March 2026 terms had no opt-out.
Who does Replika share data with for advertising?
The new policy names Meta, Google and AppsFlyer. They receive device details, website activity, app installs, sign-ups, trials and purchases, a scrambled account ID and, outside the EU, UK, Brazil and Switzerland, a scrambled email address. Replika says conversations and photos are never shared with them, and US users can opt out under Your Privacy Choices.
